  2.1 监理责任风险的含义
监理责任风险是指导致工程监理不能完成法律法规规定或合同约定的义务的一切不确定性,这些不确定性可能造成工程监理承担相应的监理责任。
监理责任的内涵是十分复杂的。从范围来说,包括合同责任和法律责任;从内容上说,包括行政责任、刑事责任和民事责任,这是由工程监理的行业特征和中国的法律制度所决定的。中国的工程监理制类似于经济发达国家的工程咨询制度。在国际工程中,咨询工程师受业主委托、为业主提供技术和管理咨询服务,其所承担的责任和义务由业主和咨询工程师签订的工程咨询服务合同进行约定,法律对此没有特别和详细的规定。而中国的工程监理同样代表业主对承包商进行监督管理,履行工程监理合同中约定的义务,承担相应的合同责任,但同时,法律、法规对工程监理的工作行为及所需承担的法律责任也进行了规定。
监理责任风险的来源是十分广泛的。目前,我国的建筑市场还不完善,市场主体存在很多违法违约现象,建设及施工单位不同程度地存在向监理单位推卸责任的现象,另一方面,工程监理的工作内容很广,如:工程质量、进度、造价、合同、协调乃至施工安全生产都属于监理的工作范围,而现代工程项目规模巨大、技术复杂,参与建设的单位众多,一旦发生工程事故,往往涉及多个责任主体,要界定不同主体的责任又是相当困难的。与此同时,在工程现场施工一线的作业工人往往是农村剩余劳动力,他们施工技术水平不高,监理的难度比较大,施工人员质量意识和安全意识的淡薄客观上也加重了工程监理的责任和风险。
